El artículo 25 del Estatuto Autonómico de Santa Cruz establece que ante la ausencia temporal del Gobernador se produce la suplencia gubernamental asumiendo estas funciones el Vicegobernador.
En caso de que tanto el Gobernador o Vicegobernador se encuentren ausentes temporalmente, una o un Asambleísta Departamental asumirá la suplencia temporal.
Entre tanto, el artículo 26 establece que el mandato del Gobernador electo cesaráúnicamente en caso de muerte, renuncia formal ante la Asamblea Legislativa Departamental, ausencia o impedimento definitivo, sentencia condenatoria ejecutoriada en materia penal en su contra y revocatoria del mandato.
En esa línea, el asesor jurídico de la Gobernación, Efraín Suárez, afirmó este miércoles que “Luis Fernando Camacho es el gobernador de Santa Cruz y lo seguirá siendo”.
La autoridad departamental llegó, junto a una comitiva, hasta el penal de Chonchocoro, en La Paz, donde Camacho guarda detención preventiva por el caso Golpe de Estado I.
Suárez mencionó que Camacho ejercerá funciones desde la cárcel e “incluso” se instalará una “sucursal de la Gobernación en Chonchocoro”.
El estatuto también establece que cuando el Gobernador y Vicegobernador queden impedidos definitivamente para el ejercicio de sus funciones, la Asamblea Legislativa Departamental procederá a la elección de una nueva autoridad de entre sus miembros.
Si hubiera transcurrido la mitad del mandato, dicha autoridad ejercerá el cargo hasta la culminación del mismo, caso contrario se deberá convocar a una nueva elección de Gobernador y Vicegobernador.
