A partir del lunes, hasta el 14 de febrero, los tribunales departamentales reciben las excusas de los ciudadanos que fueron seleccionados como jurados de mesas de sufragio para las elecciones subnacionales. Existen cuatro causales, tres alternativas dónde hacer el trámite y documentos específicos.
El viernes, los tribunales departamentales realizaron el sorteo público de 208.554 ciudadanas y ciudadanos que fueron seleccionados como jurados de mesas de sufragio. Este fin de semana, se publicaron las listas en todos los departamentos.
¿Cuántas causales existen?
Según el Artículo 65 de la Ley del Órgano Electoral Plurinacional, son cuatro las causales de excusa: enfermedad probada con certificación médica, estado de gravidez, fuerza mayor o caso fortuito comprobado documentalmente, y ser dirigente o candidato de organizaciones políticas debidamente acreditado.
El reglamento para las elecciones subnacionales toma como causales a las personas que presten servicios indispensables como personal sanitario o de emergencia, o cumplan labores el día de los comicios en medios de comunicación.
¿Dónde presentar la excusa?
Se habilitaron dos medios para que el ciudadano presente su excusa. De forma presencial en el Tribunal Electoral Departamental (TED) de la ciudad donde se registró y, de forma virtual, mediante el portal https://excusajurados.oep.org.bo/, llenando los datos y adjuntando los documentos de respaldo solicitados, según informó el Órgano Electoral Plurinacional mediante su portal Fuente Directa.
Asimismo, quienes habitan las zonas rurales, se presentarán las excusas ante el notario electoral asignado a su mesa de sufragio, quien tiene la obligación de sistematizar y remitir la información al TED dentro las 48 horas después de finalizado el periodo de excusas.
¿Qué documentos debe presentar?
Los ciudadanos deben presentar la cédula de identidad y la documentación de respaldo de la causal por la que excusa su participación. Los jurados electorales que se excusen de ejercer esta responsabilidad deben probar la causal con los siguientes documentos:
Medios de prueba para la causal de enfermedad:
- Certificado médico o baja médica extendida por el seguro de salud del afiliado.
- Certificado médico expedido en el formulario autorizado por el Ministerio de Salud para los trabajadores independientes.
- En el área rural serán válidas las certificaciones expedidas por los profesionales de los centros de salud.
- Fotocopia de la prueba PCR, con fecha actualizada, emitida por el seguro de salud o laboratorios autorizados por el Servicio Departamental de Salud (Sedes) correspondiente, para ciudadanos con COVID-19.
- Fotocopia de la prueba rápida de COVID-19, con fecha actualizada, extendida por el seguro de salud o laboratorios autorizados por el SEDES correspondiente, para ciudadanos con COVID-19.
Medios de prueba para la causal de estado de gravidez:
- Certificado médico
- Fotocopia simple del certificado de atención prenatal.
Medios de prueba para la causal de fuerza mayor o caso fortuito:
- Fuerza mayor: En caso de desastres naturales, fotocopia simple de publicaciones de prensa o certificaciones emitidas por autoridad pública.
- Caso fortuito: Certificado médico, en caso de accidente; fotocopias del pasaje, en caso de viaje fuera del país o del departamento que demuestren que no estará presente el día de la elección en su lugar de votación; podrá presentarse el pasaporte con sello de salida e ingreso u otro documento equivalente.
Asimismo, el certificado emitido por la autoridad que corresponda o del jefe superior, cuando se trate de cambio de destino laboral. Como parte de la política de seguridad de la salud, todos los ciudadanos mayores de 50 años no necesitan presentar sus excusas.
Medios de prueba para la causal de dirigente o candidato de organizaciones políticas:
- Los dirigentes de organizaciones políticas deben presentar el certificado emitido por el TSE o TED.
- Los candidatos deben entregar su certificado emitido por el TSE o TED, y/o fotocopia simple del formulario de registro o publicación de prensa.
- Personas que el día de la elección prestan servicios públicos o privados indispensables (servicios médicos de emergencia, medios de comunicación, Policía, Fuerzas Armadas) deben entregar su certificado de trabajo emitido por la entidad contratante o documento equivalente.
